Legal challenge to the guilty plea

Bryan Kohberger, 31, pleaded guilty in 2025 to four counts of first-degree murder and one felony burglary charge in connection with the November 2022 stabbing deaths of University of Idaho students Madison Mogen, Kaylee Goncalves, Xana Kernodle and Ethan Chapin. The killings occurred at an off-campus home on King Road in Moscow, Idaho. Kohberger was sentenced after entering the plea in exchange for prosecutors not seeking the death penalty, but he did not provide a motive.

Jason Goldman, a New York-based attorney, said he is joining Kohberger’s defense as out-of-state counsel. The Idaho court has not yet formally added Goldman to the docket. Idaho attorney Greg Rauch was appointed to represent Kohberger the previous month.

Goldman said the defense’s immediate priority is reviewing the constitutional issues surrounding the plea, while broader factual questions may be examined through an amended petition and an evidentiary hearing.

“We think the [amended] PCR and evidentiary hearing will naturally address some of the outstanding and unanswered questions. That said, the main priority right now is to scrutinize the constitutional issues surrounding Bryan’s plea.”

Goldman also cited the continuing support Kohberger receives from his family as one reason he agreed to join the case. He said some circumstances surrounding the plea are already public, while others are not.

Deadline for the amended petition

Judge Steven Hippler set November 13 as the deadline for Kohberger’s lawyers to file an amended post-conviction petition. The filing is expected to replace or expand on Kohberger’s handwritten submission with more detailed legal arguments prepared by counsel.

The deadline falls four years after the murders. Hippler has also set aside potential dates next year for a status conference and an evidentiary hearing, although the hearing is not guaranteed. The court will first have to consider the pending legal challenges and the prosecution’s request to dismiss the petition.

Recusal and venue motions

Kohberger’s lawyers recently asked Hippler to remove himself from the case and sought to move the proceedings back to Moscow in Latah County. The case was previously transferred to Ada County after Kohberger sought a change of venue from the county where the killings occurred.

The defense motion questions the judge’s impartiality. It points to Hippler’s refusal to give Kohberger’s former defense team additional time to complete its review of discovery before trial. The motion also cites language the judge later used to characterize Kohberger, including a statement that the court could identify nothing remaining that was “good or intrinsically human.”

In a recent filing, Deputy Latah County Prosecuting Attorney Keith Scholl requested a transcript of Kohberger’s July 2, 2025, change-of-plea hearing. Prosecutors could use Kohberger’s statements from that hearing to challenge the new allegations about how the plea was entered.

Hearings on the recusal and venue motions could take place before the November filing deadline. Goldman said the defense would allow the evidence and court filings to present its position as the case proceeds. The outcome of those motions will help determine which judge and location handle the next stage of the post-conviction litigation.
