Florida Publix Attack Suspect Completed Mental Health Court Probation

News EditorBy News EditorOctober 16, 2026 U.S. News 5 Mins Read

A Florida man accused of slashing a 70-year-old shopper at a Punta Gorda Publix had completed probation in a prior assault case about three months earlier. Police say Ramsey Thomas Lyons, 47, admitted planning to kill someone inside the store and targeting the victim because he appeared to be from the 1960s. Lyons remains jailed without bond and faces a felony aggravated battery charge.

The attack occurred Oct. 10 shortly before 4 p.m. at the Publix Super Market on Tamiami Trail. Investigators say the shopper suffered a severe cut from his cheek to his neck and a smaller chest laceration.

Publix shopper attacked in Punta Gorda store

According to a sworn probable cause affidavit, Lyons approached shopper David Terry from behind inside the Punta Gorda store. Terry reportedly felt a forceful strike, turned and saw Lyons holding a box cutter blade. He ran toward the front after discovering blood on his hands.

Officers apprehended Lyons near the entrance while he stood with his hands on his head. Police recovered a box cutter from the aisle. Emergency responders took Terry to Fawcett Memorial Hospital for treatment of a cut measuring approximately four to six inches from his left cheek to his neck, along with a minor upper-chest injury.

Police describe planning and alleged motive

Police said Lyons waived his Miranda rights and told investigators that he had spent two days planning the attack. He allegedly said he wanted to kill someone in the store and selected Terry because the shopper looked as though he was from the 1960s.

“I just pulled it out of my pocket and stuck it in his neck,” Lyons said, according to the affidavit.

Lyons reportedly said he strongly disliked the 1960s era and wanted to “ace” the victim. Investigators said he intentionally dropped the weapon so officers would not use a Taser or shoot him. These statements are allegations, and Lyons is presumed innocent unless proven guilty.

Earlier assault led to mental health court placement

The new case follows an assault at a Wawa gas station in Port Charlotte on March 13, 2025. Authorities accused Lyons of punching a 16-year-old in the face without warning while the teenager held open a door.

After that arrest, the 20th Judicial Circuit court system placed Lyons in a specialized Mental Health Court diversion program. The teenager’s mother, Shawna Gentry, said she opposed diversion and wanted jail time, alcohol classes and probation. She said she warned officials that Lyons posed an active and volatile threat.

Charlotte County court minutes show that Lyons’ probation ended July 6, with no objection from the State Attorney’s Office. The minutes included the words, “Graduation! Congratulations!” and a drawn smiley face. Gentry said the family was told Lyons would go to a mental health facility, but she believed he instead returned to outpatient supervision. She said the family received no tracking updates, safety alerts or transitional monitoring.

Research and criticism surrounding diversion programs

Mental health courts connect eligible defendants with treatment and court supervision rather than relying solely on incarceration. The National Treatment Court Resource Center counted 679 adult mental health courts nationwide at the end of 2024.

A 2021 analysis of 30 evaluations associated participation in mental health courts with 74% lower odds of repeat offending. Other research has found that recidivism among people with mental disorders is influenced more by criminal history than diagnosis. A 2005 study identified prior offenses as the strongest predictor of reoffending.

Gentry questioned whether Lyons’ conduct reflected a psychiatric crisis and said she believed he used mental health language as a legal defense. Her comments represent the family’s view, not a court finding. The State Attorney’s Office had not responded by publication time.

Current charges and upcoming court proceedings

Lyons is charged with aggravated battery on a person 65 years or older, a felony. He remains held without bond at the Charlotte County Jail. His arraignment is scheduled for Nov. 16 at the Charlotte County Justice Center.

Court records indicate that Lyons declined a public defender. It was not clear whether he had retained private counsel. The charge, statements attributed to him and the earlier case will be addressed through the court process.

No. Key Point
1 Lyons is accused of cutting a 70-year-old shopper at a Punta Gorda Publix on Oct. 10.

Summary

The allegations have drawn attention to decisions in Lyons’ earlier assault case, including the end of his probation and the lack of notice described by the prior victim’s family. The current prosecution will determine the facts and legal responsibility in the Publix attack. Lyons remains entitled to the presumption of innocence.
