Judge Keeps Death Penalty Option Open in Tyler Robinson Case

News EditorBy News EditorSeptember 3, 2026 U.S. News 5 Mins Read

Tyler Robinson will remain eligible for a potential death sentence after a Utah judge ruled that prosecutors presented probable cause he knowingly endangered bystanders in the alleged killing of Charlie Kirk. Fourth District Judge Tony Graf Jr. said the decision was based on the positions of people near Kirk, the elevated firing location and evidence that Robinson could see the area. The ruling binds all seven charges against Robinson over for trial. Robinson has pleaded not guilty, and the case is scheduled for another hearing in October.

Why the death penalty remains possible

Judge Tony Graf Jr. ruled that the alleged shooting in a crowded setting, by itself, was not enough to establish the required probable cause. Instead, he focused on whether the evidence supported a reasonable inference that Robinson knowingly created a great risk of death to someone other than Kirk.

The ruling states that the documented positions of several people around Kirk satisfied that statutory requirement at the preliminary-hearing stage. Aggravated murder is the only one of the seven charges that carries a potential death sentence. The ruling does not determine guilt or impose a punishment, but it allows the capital-punishment option to remain available as the prosecution continues.

The scene and alleged firing path

Kirk was speaking at a Turning Point USA event at Utah Valley University in Orem, Utah, on Sept. 10, 2025. He was seated beneath a branded canopy on a small stage while responding to questions from an audience that numbered in the thousands. An audience member stood at a microphone east of and in front of him, while a security guard was under the canopy and two others were positioned nearby.

Prosecutors allege that the fatal round was fired from the roof of the Losee Center, across the courtyard. In his written order, Graf said the firing point was approximately 415 feet from the canopy and 68 feet above it. The physical evidence indicated that the bullet struck Kirk from front to back and traveled downward before remaining in his body.

The relevant evidence is that the defendant allegedly discharged a .30-06 rifle toward a seated victim while several other individuals occupied positions in and around the canopy area.

Evidence of Robinson’s alleged awareness

The judge also considered evidence that Robinson allegedly visited the scene before the shooting and used a rifle fitted with an optical accessory. Graf said the southwest roof area provided a clear line of sight to Kirk’s canopy. He did not make findings about the optic’s magnification or exactly what Robinson could see through it.

Taken together, the alleged advance visit, the unobstructed view and the rifle scope supported a reasonable inference that Robinson knew other people were near Kirk when he fired, according to the order. Graf declined to assign a numerical probability to possible ricochet, over-penetration or a deviation in aim, saying those issues were not necessary to resolve the probable-cause question.

The charges moving toward trial

The court approved all seven charges for trial. In addition to aggravated murder, Robinson faces allegations of felony discharge of a firearm causing serious bodily injury, obstruction of justice, witness tampering and committing a violent offense in front of a child.

The allegation involving a child reclassifies one count from a Class B to a Class A misdemeanor and can affect sentencing on another count. Prosecutors also allege that Robinson targeted Kirk because of his political expression, but the judge’s order states that this allegation does not serve as the aggravating factor supporting possible capital punishment.

Next steps in the court case

Kathy Nester, one of Robinson’s defense attorneys, entered not guilty pleas on his behalf to every charge. The written order, issued after the preliminary proceedings, formally sends the case toward trial and reflects the reasoning Graf gave in court earlier in the week.

Robinson is due back in court on Oct. 23 for a pretrial conference. Graf may set a trial date at that hearing. The prosecution will still have to prove its allegations beyond a reasonable doubt, while the defense can challenge the evidence and the legal basis for the charges as the case proceeds.

No. Key Point
1 The death penalty remains possible because the judge found probable cause that bystanders faced a great risk of death.
2 The alleged shot came from an elevated rooftop about 415 feet from the canopy.
3 All seven charges were approved for trial, including aggravated murder.
4 Robinson has pleaded not guilty and is scheduled for a pretrial conference on Oct. 23.

Summary

The judge’s order keeps the most serious potential penalty in the case while emphasizing that the finding is limited to probable cause. The prosecution must still establish the charges at trial, and Robinson remains presumed innocent unless proven guilty.
