Parents call for extradition and accountability

Ed Bauer and Sharon Bauer, Christa’s parents, said they have been waiting for progress on Gilley’s extradition since his arrest in Italy. In a public statement, they said their family had little time to grieve before legal proceedings began and that faith in accountability had sustained them.

“We are asking that Italian and U.S. authorities work together to grant extradition. Our family doesn’t seek Lee’s death. We seek justice for Christa’s.”

The Bauers also said their Roman Catholic faith leads them to oppose capital punishment. They said justice should include improving the well-being of women and confronting violence against women.

Christa Gilley’s death and the criminal allegations

Christa Bauer Gilley, 38, was found dead inside the family’s Houston home in October 2024. She was nine weeks pregnant at the time, and prosecutors have charged her husband in connection with her death and the death of their unborn child.

The case is being handled in Harris County, Texas. Prosecutors initially pursued a capital murder case that could have exposed Gilley to the death penalty if he were convicted. Texas authorities later removed the death penalty from consideration while seeking to address Italy’s concerns about extradition.

Gilley’s flight and the Italian extradition case

Investigators say Gilley cut off his ankle monitor and left the United States in May, only weeks before his Texas trial was expected to begin. Italian authorities later arrested him, and he has been held in a jail in Turin.

Italian courts raised concerns about returning Gilley to a country where prosecutors had been seeking a capital murder case, because Italy has abolished the death penalty. Texas prosecutors removed that punishment from the case and have been waiting for Italy to approve the extradition process.

Defense disputes the murder accusation

Dick DeGuerin, one of Gilley’s attorneys, said the defendant has consistently denied involvement in his wife’s death. The defense claims that Christa’s death resulted from a pre-existing medical condition rather than homicide.

“He has insisted from the very beginning that he had nothing to do with his wife’s death.”

DeGuerin also acknowledged that Gilley’s departure could complicate the criminal case if he is returned to Houston. The attorney said prosecutors could use the flight as evidence of consciousness of guilt, although that would remain an issue for the court to consider.

Texas proceedings await a decision from Italy

Gilley appeared in an Italian court on Wednesday as authorities considered the next stage of the extradition matter. His attorney said the court did not issue a decision on whether Gilley would be returned to the United States.

Despite Gilley’s continued presence overseas, a preliminary hearing in Texas is scheduled for Friday, Oct. 9. The hearing is part of the ongoing proceedings in a case that cannot move toward a full trial unless Gilley is returned to Texas or the courts resolve the jurisdictional and extradition issues.
