A New Jersey man has been charged with two federal counts after a paid boat tour capsized in New York Harbor, killing a 27-year-old mother and her five-month-old daughter. Prosecutors allege the operator lacked required credentials, exceeded the vessel’s capacity and continued the trip without an infant life vest. Manuel Hernandez, 46, of Manville, New Jersey, appeared before U.S. Magistrate Judge Valerie Figueredo after being charged with two counts of misconduct and neglect of a ship officer resulting in death. Federal prosecutors allege that Hernandez was operating a paid tour without a Merchant Mariner Credential or a Coast Guard Certificate of Inspection.

According to the complaint, Hernandez had previously piloted at least two other tours for the same operator using his own boat and was paid about $1,000 for each trip. For the fatal excursion, he used a friend’s Yamaha AR210 because his own vessel required mechanical repairs. Prosecutors say the boat carried 14 people despite having a maximum capacity of 10.

Warnings about the infant’s life vest

Before the Aug. 8 tour began, Hernandez allegedly asked the baby’s parents whether they had an infant-sized flotation device. When they said they did not, prosecutors say Hernandez acknowledged that the boat also lacked one.

Despite that warning, Hernandez allegedly told one parent to wear an adult life vest and hold the five-month-old child during the trip. The child’s mother followed those instructions. Prosecutors argue that taking a young passenger aboard without an appropriate flotation device was among the safety failures that preceded the deaths.

How the New York Harbor boat capsized

The tour had been underway for about three hours and 20 minutes as the boat traveled toward the Statue of Liberty. Prosecutors allege that Hernandez made a U-turn and brought the vessel into a swell that may have been generated by the wake of a larger passing boat.

The complaint says Hernandez attempted to accelerate through the swell. Water then swamped the bow, and the vessel immediately capsized, throwing all 14 people into New York Harbor. Hernandez and 11 passengers survived, while two passengers were recovered unresponsive and later pronounced dead at a Brooklyn hospital.

Victims, survivors and the family’s loss

The victims were identified as Sara Sanchez, 27, and her five-month-old daughter, Antonella Garcia. Sanchez’s partner and Antonella’s father, Andres Garcia, was also aboard and survived the capsizing.

A fundraiser organized by friends and colleagues said Garcia is grieving the deaths while caring for the couple’s six-year-old son, Salvador. The campaign is seeking help with funeral expenses and other costs. Organizers wrote that no amount of money could replace Sanchez or Antonella.

Officials’ response and broader safety concerns

Federal and local officials said the case illustrates the risks of carrying paying passengers without proper authorization and equipment. Coast Guard Investigative Service Assistant Director Josh Packer said illegal charter operations “gamble with human life,” adding that the alleged conduct resulted in an unthinkable tragedy.

U.S. Attorney Jamie McDonald said Hernandez allegedly transported paying customers without the required licenses, overcrowded the vessel and accepted an infant passenger without infant life vests. Police Commissioner Jessica Tisch called the alleged conduct a complete disregard for passenger safety and said the tragedy could have been prevented. The allegations remain subject to the federal court process.
