Stephanie Minter, 41, was found with multiple stab wounds inside a bus stop shelter in Hybla Valley, Virginia, on Feb. 23, according to Fairfax County police. Abdul Jalloh, 32, was charged with second-degree murder after an employee at a local business recognized him and contacted authorities the following day.

Jalloh was taken into custody and held without bond. The charge remains an allegation, and he has not been convicted. The Fairfax County Commonwealth’s Attorney’s Office has said it cannot comment in detail while the case is pending.

“Stephanie should be alive today,” Cheryl Minter wrote in a petition. “I had to do what no parent should ever have to. I had to bury my daughter.”

The accused man’s previous arrests and immigration history

The Department of Homeland Security says Jalloh is a national of Sierra Leone who entered the United States illegally in 2012 and had been arrested more than 30 times before the killing. DHS said those cases included allegations involving rape, malicious wounding, assault and theft.

Minter has questioned why Jalloh was released after an arrest she recalled occurring during the winter before her daughter’s death. The specific details of that case and the identity of the official who authorized the release have not been independently confirmed. The earlier arrests do not establish guilt in the murder case.

“Thirty times the system had a chance to stop him. Thirty times,” Minter wrote.

Questions about Fairfax County plea policies

Minter’s criticism focuses on a 2020 policy from Descano’s office that advised prosecutors to consider immigration consequences when possible and evaluate how charges could affect a defendant’s immigration status. The policy webpage was no longer publicly available on the office’s website by May, according to reporting at the time.

Minter argues that prosecutors should place public safety first in charging and plea decisions. She said her goal is to change practices in Fairfax County and elsewhere while seeking Descano’s removal. Descano has defended the policy as fair, lawful and consistent with community values. The policy does not establish how Jalloh’s earlier cases were handled.

Federal and congressional scrutiny of the prosecutor

The Justice Department announced in May that it was investigating whether Descano’s office gave preferential treatment to defendants in the country illegally during charging decisions and plea negotiations. The department has announced no findings, and the investigation does not determine whether any specific decision contributed to the bus stop killing.

Congress is also seeking information. House Judiciary Committee Chairman Jim Jordan subpoenaed Descano on Sept. 16 as part of an inquiry into whether prosecutors consider immigration status when handling criminal suspects. Jordan set a Sept. 25 deadline after alleging that the office had not fully complied with earlier requests.

Descano’s office called the subpoena an unnecessary escalation and said the committee was conducting a partisan campaign. The office said it had provided more than 1,100 pages of documents, Descano had testified voluntarily, and it would continue responding to legitimate inquiries.

The mother’s petition and the pending prosecution

Jennifer Harrison, executive director of the Victims’ Rights Reform Council, helped Minter begin an online petition. Minter acknowledged that a petition alone cannot remove an elected prosecutor, but said it could increase attention to office policies and the handling of repeat offenders.

The prosecution remains active. Fairfax County police said Jalloh was arrested after the business employee’s report. DHS said Immigration and Customs Enforcement lodged a detainer on Feb. 25 requesting notification before any release. DHS also said it had lodged a detainer in 2020 and that an immigration judge later ordered Jalloh removed to a country other than Sierra Leone.

Minter said employees working on her daughter’s murder case have treated her well, distinguishing that support from her broader criticism of decisions she believes left a repeat offender at liberty.
