ICE officers arrested Maycon Souto Dos Reis on Aug. 3 during a targeted operation at Westborough District Court in Westborough, Massachusetts. The agency said the operation followed efforts to locate him after he came to its attention through a local motor vehicle case. Dos Reis had been arrested on May 29 in Southborough for allegedly operating a vehicle without a license.

According to ICE, Dos Reis was convicted of aggravated murder in Brazil on Sept. 14, 2024. He received a sentence of 14 years and three months in prison, and an arrest warrant was issued. The agency did not provide further information about the killing, including when it occurred or the circumstances of the conviction.

ICE said Dos Reis crossed the U.S.-Mexico border illegally in June 2024. He was apprehended at the time but later released into the United States. Federal officials characterized the case as an example of a person who may not have a U.S. criminal record despite a serious conviction abroad.

“This is yet another example of what the media often characterizes as a non-criminal, when in reality, many of these individuals are murderers, sexual predators, gang members and more: They simply do not have a criminal record in the United States,” said David Wesling, acting director of the ICE Enforcement and Removal Operations Boston Field Office.

Massachusetts restrictions on ICE operations

The arrest came two days before Massachusetts Gov. Maura Healey signed the PROTECT Act on Aug. 5. The law prevents ICE from carrying out certain operations at courthouses, schools, child-care centers, hospitals and health care facilities.

The legislation also provides additional protections for parents who are detained or deported, prohibits new agreements under the federal 287(g) program and permits civil rights claims against government officials, including ICE agents, in specified circumstances. The timing of the arrest placed the case within an ongoing dispute over the role of state and federal authorities in immigration enforcement.

Healey said the law was intended to ensure that residents could send children to school, seek medical treatment, report crimes and appear in court without fear of immigration enforcement. “The PROTECT Act is the strongest law in the country to protect people from ICE, because no one should be afraid to send their child to school, seek medical care or fear reporting a crime or appearing in court,” Maura Healey said.

ICE officials took the opposite view, arguing that sanctuary policies can make it more difficult to arrest people who are subject to immigration enforcement. David Wesling said the agency would continue pursuing people it identifies as dangerous criminal noncitizens. The Department of Homeland Security said its enforcement policy was focused on people who entered the country illegally and violated U.S. law.
