In a filing signed by outgoing Latah County Prosecuting Attorney Bill Thompson and Deputy Prosecuting Attorney Keith Scholl, prosecutors argued that the request to remove Judge Steven Hippler fails to establish legally disqualifying bias. The filing emphasized that a judge must be shown to be biased, describing that requirement as an extremely high bar.

The dispute concerns whether remarks made after Bryan Kohberger admitted guilt can demonstrate that the judge is unable to fairly handle future post-conviction proceedings. Prosecutors said the sentencing comments, considered separately or together with the defense’s other allegations, do not meet that standard. They also argued that the judge remains positioned to review post-conviction claims under Idaho law and court rules.

“In our case, the sentencing remarks are not enough to show bias,” prosecutors wrote.

Judge’s sentencing remarks draw defense objections

Kohberger’s new legal team filed the removal motion on Aug. 27. The defense argued that Judge Steven Hippler used biased language during the July 23, 2025, sentencing hearing and moved the case toward trial too quickly when Kohberger’s former attorneys were not prepared.

During sentencing, Hippler described Kohberger as a “faceless coward” and said he could find nothing “good or intrinsically human” about him. The judge also said Kohberger had “slithered” into the victims’ home and called the crime among the worst he had encountered. Hippler questioned whether Kohberger could provide a truthful explanation after entering a plea agreement that did not require him to explain his conduct.

“Do we really believe, after all of this, he is capable of speaking the truth?” Steven Hippler asked during sentencing.

Kohberger’s plea withdrawal effort moves forward

Bryan Kohberger pleaded guilty on July 2, 2025, to four counts of first-degree murder and one burglary charge. In a handwritten petition filed in July, he alleged ineffective assistance of counsel and argued that his plea was not knowingly or voluntarily entered. He claimed it was influenced by unfulfilled promises and threats from members of his legal team.

Kohberger had waived his appeal rights but said he intended to pursue post-conviction relief. The court appointed Greg Rauch, an attorney from Moscow, Idaho, to handle the case. Kohberger’s family also retained New York attorney Jason Goldman. Prosecutors previously sought transcripts from the change-of-plea and sentencing hearings, where Kohberger affirmed that he understood the plea and was entering it knowingly and without coercion.
