Texas Surrogacy Custody Fight Intensifies as Newborn Remains Critically Ill

News EditorBy News EditorAugust 25, 2026 U.S. News 5 Mins Read

A critically ill newborn remains under hospital care after being placed back on a breathing tube following surgery for a severe congenital heart defect. The child is at the center of a custody and medical decision-making dispute between his Texas surrogate and the California couple who intended to become his parents. A Dallas judge heard arguments Tuesday but left a temporary custody order in place without ruling on permanent conservatorship. The case also includes competing claims over an alleged request to terminate the pregnancy and an underlying financial dispute involving the surrogacy agreement.

Newborn’s condition worsens after heart surgery

The newborn was re-intubated after his condition declined overnight following a Norwood procedure, according to court filings. The operation is used as the first of three open-heart surgeries generally performed for infants with hypoplastic left heart syndrome, or HLHS. The intended parents, Nausheen Gilkar and Omar Ahmed, said the child experienced possible complications, struggled to breathe, choked on tubes and required a blood transfusion.

The baby remains in critical condition and is being closely monitored at a hospital in Dallas. The intended parents refer to him as Rumi, while surrogate McKenna West calls him Gabriel. The differing names reflect the larger disagreement over parental authority and the child’s future care.

Custody and medical authority disputed in Dallas

At a Dallas family court hearing on Tuesday, Gilkar and Ahmed faced West over who should make medical decisions. West is seeking sole conservatorship, which would place decision-making authority in her hands. The intended parents have sought to retain custody under a temporary restraining order issued during the legal dispute.

The judge kept an order barring West from seeing or holding the baby in place and did not immediately resolve the broader custody question. Gilkar told the court that she and Ahmed had remained at their son’s bedside during treatment.

“He’s our child,” Gilkar said, describing the newborn as “the love of our lives” and saying, “He’s suffering a lot.”

Heart defect and treatment timeline

Doctors diagnosed the baby with HLHS at about 20 weeks of pregnancy. The condition leaves one side of the heart underdeveloped and interferes with normal blood flow. Without treatment, it can be fatal within days or weeks, according to federal public health information.

The child was born in Texas on Aug. 12 after West traveled there during the pregnancy. Doctors determined on Aug. 14 that he was eligible for the Norwood procedure, according to the intended parents’ attorney. Gilkar and Ahmed consented to the operation, which was performed Aug. 17. The baby’s condition was described at that time as critical and complex.

Competing claims over care and pregnancy decisions

West says the intended parents asked her to terminate the pregnancy after the heart defect was diagnosed, but that she refused. She has argued that the court should ensure the newborn continues to receive life-saving treatment. West also said she would abandon her custody request if the court determined that Gilkar and Ahmed were committed to providing that care.

The couple’s attorney disputes important parts of West’s account and says the intended parents agreed to the baby’s treatment. Their filings state that they have been involved in the child’s care and consented to the surgery. The conflicting accounts are central to the court’s consideration of custody and medical authority.

Broader legal fight continues after the birth

The custody dispute is part of a separate legal battle over the surrogacy contract. Before the birth, Gilkar and Ahmed filed counterclaims seeking more than $100,000, alleging that West breached the agreement and caused emotional distress. The claims say the couple paid West $60,000 during the pregnancy under an agreement addressing termination. West has denied wrongdoing and asked the court to dismiss the claims.

Before the birth, Texas Attorney General Ken Paxton obtained an emergency order directing that medically necessary care not be delayed or obstructed. His office also notified two Dallas medical centers of their obligations to provide life-saving treatment. The court has not yet issued a final ruling on custody or conservatorship.

Key Points
Number Key Point
1 The newborn remains in critical condition after a Norwood heart procedure and renewed breathing support.
2 A Dallas judge has not yet decided permanent custody or medical decision-making authority.

Summary

The legal conflict remains unresolved while the newborn receives intensive medical care. The immediate focus is his survival and continued treatment, while the court weighs competing claims from the surrogate and intended parents regarding custody, conservatorship and medical decisions. Separate contract and damages claims are also pending.
