Ohio Man Convicted in Point-Blank Restaurant Attack on Ex-Wife

News EditorBy News EditorSeptember 12, 2026 U.S. News 5 Mins Read

An Ohio man has been convicted of attempted murder after prosecutors said he pointed a handgun at his ex-wife’s head inside a Toledo restaurant and pulled the trigger. The gun failed to fire because its safety was engaged, and a waiter tackled the man before he could try again. The confrontation occurred on April 11, 2025, while the woman was dining with her parents.

A Lucas County jury found Matthew Exton guilty on Sept. 4, 2026, of attempted murder, two counts of felonious assault and two firearm specifications attached to the charges. He is scheduled to be sentenced on Sept. 21, 2026.

Restaurant encounter escalates into an alleged shooting attempt

According to the Lucas County Prosecutor’s Office, Matthew Exton, 43, was having a drink at Souk restaurant in Toledo, Ohio, on April 11, 2025. He reportedly saw his former wife, Kada Malone, eating with her parents, Jeannie Malone and Charles Malone, at the nearby Italian restaurant Sabira.

Prosecutors said Exton entered Sabira, ordered a drink for Malone’s table, spat in the family’s direction and left. Surveillance footage later showed him returning with a handgun. The prosecution described the conduct as an intentional attack carried out in a public dining area rather than an ordinary restaurant visit.

“The defendant did not come with the intention of having a meal. He came with anger in him and with the intention to commit a public execution of his ex-wife at the restaurant that day.”

The statement was attributed to Lucas County Prosecuting Attorney Julia R. Bates, who also praised the employees and patrons who intervened.

Handgun fails to fire as bystanders intervene

Security video showed Exton approaching Malone’s table and bringing the handgun to within point-blank range of her head. As she raised her hands toward her face, he pulled the trigger, but the weapon did not fire. Prosecutors said the safety was still on, preventing the shot.

Authorities said the handgun contained a round in the chamber and seven additional bullets in its magazine. Before Exton could make another attempt, a waiter tackled him from behind. The intervention ended the immediate threat and allowed authorities to take him into custody.

The evidence and testimony focused on how quickly the incident developed, the presence of family members and restaurant patrons, and the actions of the employee who stopped Exton. The two felonious-assault counts involved Malone’s parents, who were also present at the table.

Jury convicts former attorney on multiple charges

The jury returned its verdict on Sept. 4, 2026, finding Exton guilty of attempted murder and two counts of felonious assault. The panel also found him guilty of two firearm specifications connected to all three underlying offenses.

Exton was previously a lawyer and local prosecutor. The case was based on the restaurant surveillance footage, the circumstances of the loaded handgun and testimony concerning the encounter. Prosecutors argued that his actions demonstrated an intent to kill Malone and placed her parents in danger.

The guilty verdict resolved the trial phase of the case but did not determine the final punishment. That decision is scheduled to be made at a later hearing.

Courtroom outburst follows discussion of threatening voicemail

During closing arguments, prosecutors referred to a voicemail Exton had left for Malone before the restaurant incident. The message referenced the Johnny Cash lyric “Sooner or later God will cut you down,” which prosecutors presented as evidence of threatening behavior and his state of mind before the alleged attack.

Exton appeared to object to the way the voicemail was characterized. After the verdict, he began shouting lyrics from the song “God’s Gonna Cut You Down” as court officers removed him from the courtroom. At another point, he made a gun-like gesture with his fingers and pointed it at assistant Lucas County Prosecutor Rose Mock.

The judge instructed jurors to disregard Exton’s courtroom conduct and not allow it to affect their deliberations. The conduct occurred after the jury had reached its verdict.

Sentencing is scheduled for September

Exton is scheduled to be sentenced on Sept. 21, 2026, in Lucas County. The sentencing hearing will address the consequences of the attempted murder, felonious-assault convictions and firearm specifications.

The case drew attention because surveillance footage captured the alleged attack inside a busy restaurant and showed the immediate intervention by a waiter. Prosecutors said those who stepped in helped prevent further violence, while the conviction established the jury’s finding that Exton was criminally responsible for the attempted shooting and threats to the family.
