Federal charges follow the New York Harbor capsizing

Manuel Hernandez, 46, of Manville, New Jersey, was charged on Monday with two counts of misconduct and neglect of a ship officer resulting in death. He appeared before U.S. Magistrate Judge Valerie Figueredo in federal court. Each charge carries a maximum sentence of 10 years in prison.

The charges stem from the August 8 nighttime capsizing of a Yamaha AR210 during a paid excursion in New York Harbor near the Statue of Liberty. Federal prosecutors allege Hernandez was piloting the boat despite lacking a Merchant Mariner Credential and a Coast Guard Certificate of Inspection required for the operation.

According to the federal complaint, 14 people were aboard the vessel, although its maximum capacity was 10. Prosecutors also allege Hernandez was not licensed to carry paying passengers and had previously operated at least two other tours for the same company using his own boat. Investigators say he acknowledged lacking the required credentials and receiving about $1,000 for each trip.

Before the fatal tour began, Hernandez allegedly asked the infant’s parents whether they had a flotation device sized for the child. When they said they did not, he allegedly told them the boat also had no infant life vest. Despite that warning, prosecutors say Hernandez instructed one parent to wear a life vest and hold the baby during the excursion. The mother, identified as Sara Sanchez, did so.

A swell preceded the vessel’s sudden capsize

About three hours and 20 minutes into the trip, Hernandez was allegedly steering toward the Statue of Liberty when he made a U-turn. The vessel entered a swell that prosecutors said may have been created by the wake of a larger passing boat.

The complaint alleges Hernandez attempted to accelerate through the swell. Water then swamped the bow, and the vessel immediately capsized, throwing all 14 people into the harbor. Hernandez and 11 passengers survived. Sanchez and her infant daughter were recovered unresponsive and later pronounced dead at a Brooklyn hospital.

The victims were identified as Sara Sanchez, 27, and her five-month-old daughter, Antonella Garcia. Sanchez’s partner and Antonella’s father, Andres Garcia, was also aboard the boat and survived the capsizing.

A fundraiser organized by friends and colleagues said Garcia is now grieving the deaths while caring for the couple’s six-year-old son, Salvador. The campaign is seeking assistance with funeral expenses and other costs. Organizers wrote that no amount of money could replace Sanchez or Antonella.

Officials say the operation exposed serious commercial boating risks

The boat involved belonged to a friend and was smaller than Hernandez’s own vessel, which prosecutors say needed mechanical repairs. Hernandez allegedly told investigators that he did not know the borrowed boat’s maximum capacity. He initially expected 12 passengers before ultimately agreeing to take 13, although 14 people were aboard during the trip.

Josh Packer, assistant director of the Coast Guard Investigative Service, said illegal charter operations put passengers at risk.

“Illegal charter operations gamble with human life. In this case, the alleged conduct led to an unthinkable tragedy,” Packer said.

Jamie McDonald, the U.S. attorney, said Hernandez allegedly transported paying customers without appropriate licenses, overcrowded the vessel and took a five-month-old passenger aboard without infant life vests. New York Police Department Commissioner Jessica Tisch described the alleged conduct as a complete disregard for passenger safety and said the tragedy could have been prevented.
