Tennessee Lawyers Seek Commutation for Christa Pike After Failed Execution

News EditorBy News EditorOctober 1, 2026 U.S. News 5 Mins Read

Christa Pike survived an attempted lethal injection in Tennessee after receiving two doses of pentobarbital, leaving her in critical condition and receiving lifesaving medical care. Her lawyers are asking Gov. Bill Lee to commute her death sentence to life in prison rather than permit another execution attempt. Lee has halted Pike’s execution and the state’s other scheduled execution this year while ordering an independent review. The case has renewed scrutiny of Tennessee’s execution procedures and the use of lethal injection.

A failed execution leaves Pike in critical condition

Christa Pike, 50, was scheduled to be executed in Tennessee on Wednesday night for the 1995 killing of classmate Colleen Slemmer. Witnesses said Pike remained conscious after the first dose of pentobarbital and complained of pain in her arm. A second dose was administered about an hour after the curtains were initially raised, but Pike could still be heard snoring until the microphone was cut off nearly 30 minutes later. She was taken to a hospital and remained in critical condition the following day.

Before the procedure, Pike reportedly said she was at peace and ready to be free. Her attorney, Randy Spivey, said at a news conference that the legal team did not yet know her prognosis but confirmed that she was alive and receiving intensive medical treatment.

“We don’t have a sense of her prognosis or much update on her health at the moment. But we know she is alive right now,” attorney Randy Spivey said.

Lawyers and experts seek a sentence commutation

Pike’s lawyers filed an emergency motion with the Tennessee Supreme Court seeking to halt and stay the execution. They argued that the failed attempt subjected Pike to unnecessary agony and that another attempt could violate protections against cruel and unusual punishment. They are now asking Bill Lee to replace the death sentence with life imprisonment.

Death penalty expert Robin Maher also called on the governor to commute the sentence. Maher cited Pike’s reported childhood and young-adult experiences with gender-based violence and abuse, arguing that subjecting her to another execution attempt would be irresponsible.

“It would be irresponsible for state officials to put her through another attempt at execution,” Robin Maher said, describing the experience as torturous and unprecedented.

About 25,000 people had signed a petition urging Lee to commute Pike’s sentence before the execution. An appeals court had previously paused the execution on Wednesday, but the U.S. Supreme Court overturned that stay later the same day.

Tennessee pauses executions and orders a review

Lee halted further efforts to execute Pike and suspended the state’s other scheduled execution this year. He ordered a third-party review after describing the incident as deeply disturbing. The review is expected to examine how the drugs were administered and why Pike remained alive after receiving them.

The incident was the second failed execution in Tennessee this year. In May, officials did not administer lethal drugs to Tony Carruthers, who was convicted of kidnapping and murdering three people in 1994, because they could not find a suitable vein for an intravenous line. Similar problems have led other states to pause executions.

Pike’s case has a long history of legal and medical concerns

Pike was 18 when she helped kill Colleen Slemmer, a 19-year-old classmate. Her then-17-year-old boyfriend, Tadaryl Shipp, was convicted and sentenced to life with the possibility of parole because he was a juvenile and ineligible for execution. A third defendant, Shadolla Peterson, testified for prosecutors after acting as a lookout and avoided a death sentence.

Pike did not dispute her role in the killing. Her supporters have argued that her mental illness and allegations of severe childhood sexual abuse should have been considered. She was diagnosed with bipolar disorder and post-traumatic stress disorder after the crime and previously described herself as a mentally ill 18-year-old who only later understood the seriousness of her actions.

The case highlights broader problems with executions

Tennessee changed from a three-drug lethal injection protocol to the single-drug use of pentobarbital in 2024. In 2022, the state abruptly halted the execution of Oscar Smith after acknowledging that it had not properly tested its lethal injection drugs. Smith was later executed by lethal injection.

Experts have documented numerous botched executions involving failed intravenous access or other medical problems. However, Pike’s case is distinct because she remained alive after receiving doses intended to be lethal. She would have been the first woman executed in Tennessee in more than 200 years and the 30th person executed in the United States this year. Since 1976, 18 women have been executed in the country, representing about 1% of all executions.

Key Points
Number Key Point
1 Pike survived two doses of lethal injection drugs and was hospitalized in critical condition.
2 Her lawyers and death penalty experts want her sentence changed to life in prison.
3 Tennessee suspended executions and ordered an independent review.
4 The state has experienced another failed execution this year involving intravenous access.

Summary

The failed execution has placed Tennessee’s lethal injection procedures under renewed scrutiny and created a direct legal and ethical question for the governor. While the state review proceeds, Pike’s lawyers argue that another attempt would impose unconstitutional and unnecessary suffering. Any decision on commutation will also be considered against the history of the underlying murder, Pike’s mental health and abuse allegations, and the state’s record of execution problems.
