Former West Point Cadet Sued Over Secret Administration of Abortion Medication

News EditorBy News EditorNovember 2, 2026 U.S. News 5 Mins Read

A former U.S. Military Academy cadet is facing a civil lawsuit over allegations that he secretly administered abortion medication to his pregnant girlfriend in 2022. The woman, identified in court documents as Jane Doe, alleges assault and battery and is seeking compensatory and punitive damages. Caleb T. Suh pleaded guilty in federal court to assault resulting in substantial bodily injury to a dating partner and is awaiting sentencing.

The lawsuit was filed in New York Supreme Court on October 28, 2026. It alleges that Suh obtained the medication through an online pharmacy account created using Doe’s identity, concealed his intentions and gave her a drink containing medication intended to sedate her before administering the abortion drugs.

Doe became seriously ill after the February 4, 2022, incident and was hospitalized, where doctors confirmed she was experiencing a miscarriage. Suh’s federal sentencing has been postponed until January 2027.

Civil lawsuit follows federal guilty plea

Jane Doe filed the lawsuit against Caleb T. Suh in New York Supreme Court on October 28, 2026. The complaint concerns conduct that allegedly occurred while both individuals were cadets at West Point in February 2022. Doe accuses Suh of assault and battery and is seeking financial compensation for the physical and emotional harm she says resulted from the incident.

The civil case follows Suh’s federal guilty plea on June 30, 2026, to assault resulting in substantial bodily injury to a dating partner. His admissions in the criminal case include obtaining abortion medication without Doe’s knowledge or consent and administering it after using medication intended to sedate her.

Pregnancy dispute and alleged coercion

According to the complaint, Doe learned she was pregnant with Suh’s child in January 2022 and told him she intended to continue the pregnancy. The lawsuit alleges that Suh repeatedly pressured her to have an abortion before later appearing to support her decision to keep the baby.

The complaint says Suh used Doe’s identification to create an online pharmacy account in her name and obtain abortion medication. On February 4, 2022, he allegedly brought a drink to her barracks room and described it as a pregnancy protein shake. Doe became ill and moved in and out of consciousness, according to the filing.

“My intent was use the Xanax to unwittingly sedate my girlfriend so that I could then administer the abortion pills, which I had obtained via the online pharmacy,” Suh said, according to the complaint.

Hospitalization and criminal investigation

After drinking the beverage, Doe became seriously ill and was taken to a hospital. Doctors determined that she was suffering a miscarriage. The complaint alleges that the miscarriage resulted from the abortion medication Suh administered without her knowledge or consent.

Doe reported the incident to the Army Criminal Investigation Division at West Point in May 2022. Federal charges were filed in June 2026, and Suh later acknowledged that he had deceived Doe about supporting the pregnancy and had obtained Xanax to facilitate the administration of the medication.

Education and university responses

After leaving West Point, Suh attended Cornell University and graduated in May 2026. Cornell said that, when he transferred, he answered no when asked whether he had been found responsible for a disciplinary violation at a previous school. The university said his previous institution had reported that he was in good academic standing and eligible to return.

Suh later enrolled in a master’s program at Columbia University’s Mailman School of Public Health. A person familiar with the matter said Columbia was unaware of his status until contacted by a newspaper and then took swift action. The person also said the school’s application did not require applicants to disclose prior criminal convictions.

Damages claim and next legal steps

Doe is seeking both compensatory and punitive damages in the New York lawsuit. Her attorney, Russell Kornblith of Wigdor LLP, said the complaint describes severe trauma and the loss of a wanted pregnancy, while accusing Suh of continuing his education at highly selective universities.

Suh asked a federal judge in October to delay sentencing until January 2027, partly so he could complete his semester at Columbia. Federal prosecutors did not oppose the request, and Philip M. Halpern granted it. West Point and Suh’s attorney had not immediately responded to requests for comment at the time of the report.
