Butler was 17 when he was charged as an adult in Payne County in March 2025. Prosecutors accused him of offenses connected to alleged attacks on two girls he had dated. The original case included 10 felony counts, including two counts of attempted first-degree rape, three counts of rape by instrumentation, sexual battery, forcible oral sodomy, two counts of domestic assault and battery by strangulation, and domestic assault and battery.

At the final review hearing on Aug. 3, 2026, prosecutors said they would not seek to transfer Butler into the custody or supervision of the Oklahoma Department of Corrections. The court’s jurisdiction expired at midnight on Aug. 4, when Butler turned 19. The case was then dismissed by operation of law, ending the state proceedings without a prison term.

District attorney’s response and federal referral

The final hearing became contentious after defense attorney Derek Chance suggested that Butler was innocent and had been victimized by the case. Newly elected Payne and Logan County District Attorney Jeremiah Gregory strongly rejected that characterization.

“The defense portrayed that somehow the perpetrator suffered more than these victims. What was said was insincere, untruthful and an affront to these victims and what they have endured.”

Gregory said the defense assertions were disingenuous and said the matter had made him extremely angry. He also stated that Oklahoma could not prosecute Butler again because of constitutional double jeopardy protections. Instead, his office said it would refer the matter to the appropriate federal agency for prosecutorial review.

The state case is closed, and Gregory acknowledged that his office cannot reverse the outcome. He said he would continue to advocate for victims of violent crime. The federal referral creates the possibility of additional review, but no federal charges had been announced at the time of the report.
